Terms of Service
These Terms of Service ("Terms") govern your use of the BondProof mobile application and website at bondproof.app ("Service"), operated by BondProof ("we", "us", "our"). BondProof is a rental inspection documentation tool for renters, tenants and property managers in Australia, New Zealand and the United Kingdom.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any equivalent consumer protection legislation in New Zealand or the United Kingdom. Statutory guarantees under the ACL cannot be excluded.
1. About BondProof
BondProof is operated as a sole trader business in Australia (ABN: 84 205 810 721). Contact: contact@bondproof.app. The Service is available to users in Australia, New Zealand and the United Kingdom. References to "BondProof", "we", "us" or "our" in these Terms refer to the operator of the Service.
Our handling of personal information is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. For full details of how we collect, store, and protect your data - including data breach notification obligations under the Notifiable Data Breaches scheme and how to contact the Office of the Australian Information Commissioner (OAIC) - see our Privacy Policy.
Your inspection photos and data are stored on Supabase infrastructure, which may be hosted in Australia or the United States. By using the Service, you acknowledge this. Full details are in our Privacy Policy.
2. Eligibility
You must be at least 18 years of age to use BondProof. By using the Service, you confirm that you are 18 or older. The Service is not directed at persons under 18, and we do not knowingly collect personal information from minors.
3. Description of Service
BondProof provides a mobile application that allows users to:
- Document rental properties through timestamped, geolocated photos and written notes organised by room.
- Generate PDF inspection reports for move-in and move-out inspections.
- Store inspection photos and reports securely for future access and dispute purposes.
BondProof is a documentation tool only. We do not provide legal advice. Reports generated by BondProof may be used as supporting documentation in rental bond or deposit disputes, tenancy tribunal hearings, or other proceedings. We make no guarantee as to their acceptance or outcome in any legal, tribunal, tenancy or claims process. The weight given to any report is determined by the relevant tribunal, court, or adjudicator.
4. Account Registration
You must create an account to use the Service. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately at contact@bondproof.app if you suspect unauthorised access to your account.
We are not liable for any loss or damage arising from your failure to keep your credentials secure.
5. Payments, Refunds and Australian Consumer Law
Certain features of BondProof require a one-time payment. Prices are displayed at checkout and may vary by country. Payments are processed by Stripe. Local taxes apply where required by law.
Refund policy: because your PDF report is generated and delivered immediately upon payment, we do not offer change-of-mind refunds once your report has been successfully generated and delivered.
Your statutory rights are not affected. If you are an Australian consumer, the Australian Consumer Law provides guarantees that cannot be excluded. If the Service fails to meet a statutory guarantee - for example, if a report is not generated due to a fault in our system - you are entitled to a remedy under the ACL. Contact us at contact@bondproof.app within 14 days of the issue and we will resolve it, including providing a refund where required under the ACL.
New Zealand consumers have equivalent rights under the Consumer Guarantees Act 1993 (NZ). UK consumers have rights under the Consumer Rights Act 2015 (UK).
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload fraudulent, fabricated, or misleading photos or content.
- Use the Service to produce false inspection records intended to deceive a landlord, agent, tribunal, or court.
- Attempt to reverse engineer, copy, modify, or exploit the Service or its infrastructure.
- Use the Service to harass, defame, or harm any person.
- Attempt to gain unauthorised access to any part of the Service, its database, or file storage.
7. Intellectual Property
All content, branding, code, design, and materials forming the Service are owned by BondProof or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
You retain full ownership of the photos and content you upload to BondProof. We do not claim any intellectual property rights over your inspection content.
8. User Content
By uploading photos and content to BondProof, you grant us a limited, non-exclusive, non-transferable licence to store, process, and display that content solely for the purpose of providing the Service to you. This licence ends when you delete your account and your data has been removed from our systems.
We will not share your content with third parties except as strictly necessary to operate the Service (for example, cloud storage and email delivery providers), as described in our Privacy Policy.
9. Data Deletion on Account Closure
When you close your account or request deletion, all your personal data - including inspection photos, PDF reports, property addresses, and account information - will be permanently deleted from our systems within 30 days of your request. Deletion is irreversible. We recommend downloading any reports you wish to keep before requesting deletion.
To close your account and request data deletion, email contact@bondproof.app with the subject "Account Deletion Request".
10. Third-Party Services
The Service integrates with third-party providers including Supabase (database and storage), Stripe (payment processing), Google Places API (address autocomplete), and Zoho Mail (transactional email). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
11. Disclaimer of Warranties
Subject to any non-excludable statutory guarantees under the Australian Consumer Law or equivalent legislation, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities. We do not guarantee that inspection reports will be accepted as evidence in any legal proceeding, tribunal, or dispute process.
12. Limitation of Liability
To the maximum extent permitted by applicable law - and subject to any non-excludable rights under the Australian Consumer Law, Consumer Guarantees Act 1993 (NZ), or Consumer Rights Act 2015 (UK) - BondProof shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Where our liability cannot be excluded under applicable consumer law, our liability is limited to the greater of: (a) resupplying the relevant service; or (b) the amount you paid for the Service in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold harmless BondProof and its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms, or your violation of any rights of a third party.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms are subject to the courts of Victoria, Australia, where permitted by law. Where mandatory consumer protection laws in your jurisdiction provide additional rights (including in New Zealand and the United Kingdom), those rights apply in addition to these Terms and are not excluded by this clause.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised date. For significant changes, we will attempt to notify you by email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
16. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct harmful to other users or the integrity of the Service. We will give reasonable notice where practicable unless immediate termination is necessary to prevent harm. You may terminate your account at any time by contacting us at contact@bondproof.app.
